Eligibility and lawful use

You must be authorized to enter into contracts under the law applicable to you and to use our services for lawful purposes. Use in professional, commercial or consumer contexts must comply with these Terms and any local regulations governing water systems, data handling and safety.

Users must be at least 18 years old or otherwise able to form binding legal agreements in their jurisdiction to create an account and access paid services.

You agree not to use our services for illegal activities, to interfere with network operations, to bypass security controls, or to process personal data in violation of applicable data protection laws.

Some services may not be available in all jurisdictions. It is your responsibility to ensure your use of AirTopFlow services complies with local laws and export controls.

Account management

Account registration requires accurate information and ongoing maintenance of account details. Accounts may be created for individuals or organizations using provided sign-up methods.

You are responsible for maintaining the accuracy of account information. AirTopFlow may suspend or limit access if account details are incomplete or suspect.

Protect your account credentials and enable available security features. Notify AirTopFlow promptly of any unauthorized access or loss of credentials to reduce risk.

Accounts, access credentials and subscriptions are non-transferable without explicit written consent from AirTopFlow.

If you suspect your account has been compromised, contact our support team immediately at [email protected] so we can contribute and take appropriate measures.

AirTopFlow may suspend or terminate accounts that violate these Terms, pose a security risk, or are inactive for extended periods. We will provide notice where practicable.

Services provided

AirTopFlow provides AI-driven software, analytics, device integrations and managed services for water quality monitoring, flow optimization and hydration management. Service scope for each customer is defined in order forms, statements of work or subscription descriptions.

Service features and integrations may change over time. AirTopFlow will communicate material changes and provide transition guidance where necessary for continuity of service.

We design systems for high availability but occasional outages or maintenance windows may occur. We publish scheduled maintenance notices and reasonable support channels for incident reporting.

Acceptable use rules

When using AirTopFlow services you must adhere to the following rules to maintain safety, system integrity and lawful operation.

• Do not attempt to reverse engineer, decompile or circumvent security features of AirTopFlow software or devices.
• Do not use the services to send spam, distribute malware, or perform network attacks.
• Do not upload or transmit content that is unlawful, defamatory, abusive or infringes third-party rights.
• Do not interfere with other customers' use of the service or extract competitive intelligence from the platform.
• Operate hardware and installed devices according to regulatory and safety standards applicable in your jurisdiction.
• Comply with data protection obligations when transmitting personal data through our services.
• Report security vulnerabilities or misuse promptly to AirTopFlow so we can mitigate risks.

User content

You retain ownership of content you submit to AirTopFlow, such as configuration data, telemetry, images and documentation, subject to the license you grant us below.

All intellectual property rights in user-submitted content remain with you, except for any rights you grant to AirTopFlow to provide the services.

By submitting content you grant AirTopFlow a worldwide, non-exclusive, royalty-free license to use, host, reproduce, modify and display that content as reasonably necessary to provide, maintain and improve the services.

You are responsible for the legality, accuracy and appropriateness of user content and for obtaining any consents required under applicable law before uploading personal data.

AirTopFlow may remove user content that violates these Terms or applicable law. We will attempt to notify you when removal is required or when possible under legal constraints.

Intellectual property

AirTopFlow and its licensors retain all rights, title and interest in our software, documentation, activity and service marks. Nothing in these Terms transfers ownership of AirTopFlow intellectual property to you.

• Do not copy, modify or create derivative works of AirTopFlow software except as expressly permitted.
• Do not remove or alter proprietary notices, labels or marks from AirTopFlow materials or device firmware.
• Requests to use AirTopFlow activity or logos require prior written permission.

Paid services and subscriptions

Certain AirTopFlow products and cloud features are offered on a paid subscription or project basis. Paid services are governed by the applicable order form, price list and these Terms.

Prices are set in the order or subscription agreement. Taxes, duties and third-party fees are additional unless specified. Pricing for custom projects is established in statements of work.

Payments are due as set out in invoices or subscription terms. Accepted payment methods are detailed during purchase. Late payments may incur interest and suspension of services.

Subscription services renew automatically unless cancelled in accordance with the subscription terms. Term length and renewal timing are specified in your agreement.

Refunds for paid services are considered on a case-by-case basis in accordance with the applicable order and refund policy. Where refunds are permitted, processing is subject to verification and administrative handling.

You may cancel subscriptions as allowed by your plan; cancellation does not entitle you to retroactive credits for elapsed billing periods except where expressly provided.

You are responsible for all taxes, duties and levies associated with your purchases, excluding taxes on AirTopFlow's net revenue.

AirTopFlow may adjust pricing with prior notice for renewals or new subscriptions. Existing fixed-term agreements will be honored until renewal unless otherwise agreed in writing.

Failure to pay may result in suspension or termination of services. AirTopFlow will attempt to notify you of non-payment and provide a window to cure before action.

Disclaimer

Information and materials provided by AirTopFlow are provided 'as is' for informational purposes. While we strive for accuracy and reliability in our AI models and data, performance depends on field conditions, data quality and installation. Clients are advised to validate critical measurements and follow local engineering and regulatory standards.

Limitation of liability

To the maximum extent permitted by applicable law, AirTopFlow's liability for direct damages arising out of or in connection with these Terms is limited to fees paid by you for the service in the 12 months prior to the event. AirTopFlow is not liable for indirect, consequential, special or incidental damages, loss of benefits or loss of business opportunity.

Third-party services

We may integrate third-party tools, analytics and cloud services. Use of third-party services is subject to the third party's terms and policies; AirTopFlow is not responsible for third-party performance, content or privacy practices.

Termination

Either party may terminate for material breach where the breach remains uncured after a reasonable cure period. AirTopFlow may suspend or terminate access for violations of these Terms or for security reasons.

On termination, your access will end and we may delete or archive data in accordance with our data retention practices. Fees owed prior to termination remain payable.

Privacy and data protection

Our Privacy Policy explains how we collect, use and protect personal data in connection with the services. By using AirTopFlow services you consent to processing consistent with our Privacy Policy and applicable law.

Communications

We may communicate via email, phone or portal messages regarding account, billing, security and product updates. You agree to receive such communications as necessary to operate service and maintain compliance.

Changes to the Terms

AirTopFlow may update these Terms from time to time. We will post revised terms on AirTopFlow.info with an updated effective date. Continued use after changes constitutes acceptance of the updated Terms.

Governing law

These Terms are governed by the laws of Malaysia. Any dispute arising under or related to these Terms shall be subject to the exclusive jurisdiction of the courts of Kedah, Malaysia, unless otherwise agreed in writing.

Dispute resolution

Parties will first try to resolve disputes through good faith negotiations. If unresolved within 60 days, either party may pursue legal remedies in accordance with the governing law and jurisdiction provisions.
